Judicial Management Application led by a creditor and the appointment of an Interim Judicial Manager
Maybank Islamic Berhad v. Khee San Food Industries Sdn Bhd
On 15.11.2021, an application was filed in the Kuala Lumpur High Court by Maybank Islamic Berhad, to place its debtor, KSFI, under judicial management pursuant to Section 405 of the Companies Act 2016. We act for the Bank.
On 17.11.2021, our firm successfully obtained, on behalf of the Bank, an ex parte Order for the appointment of an Interim Judicial Manager over KSFI, pending the disposal of the application for a judicial management Order. This is one of the very few instances where the Malaysian Court has granted an ex parte Order for the appointment of an Interim Judicial Manager pending the disposal of the judicial management application.
The application for a judicial management Order is pending hearing.
The hearing for the appointment of the interim Judicial Manager was conducted by our Ms. Ng Hooi Huang together with Mr. Jayden Lim Jia Wing.
