Overview

Joseph Yu Shi Yang joined Shook Lin & Bok as a pupil in 2018 and was admitted to the Malaysian Bar in the same year. Since the end of 2018, he has been practising as an advocate and solicitor with the firm and was elevated to the position of partner on 1 January 2025.

Joseph has developed prowess in intellectual property law and information technology, advising clients across jurisdictions including Malaysia, Singapore, Indonesia, China, Hong Kong, Thailand, and Vietnam. He is adept at managing intellectual property portfolios and addressing complex legal challenges for both local and international clients.

His practice includes providing advice on trademark matters, conducting corporate intellectual property due diligence, and drafting and reviewing licensing, distribution, assignment, and franchise agreements. Joseph is also experienced in cross-border transactions, ensuring efficient and practical solutions for multi-jurisdictional legal issues.

In the area of litigation, Joseph regularly appears before the High Court and Court of Appeal in intellectual property disputes. He is committed to safeguarding his clients’ interests and has been recognised for his meticulous approach to contentious matters. His contributions have been acknowledged by The Legal 500 Asia Pacific, where he was named a Rising Star Lawyer in 2023 and 2024.

Work Experience

IP Litigation

  • Successfully defended a prominent Malaysian public company against an application for the revocation of its registered trademark at the High Court.
  • Commenced a patent invalidation action for a well-known international pharmaceutical company, negotiating between parties and securing a favourable judgment in default.
  • Represented a Malaysian banking institution in the first case involving the partial revocation of a trademark under the new Trademarks Act 2019. Acted as junior counsel in the appeal before the Court of Appeal and continue to represent the client in its application for leave to appeal to the Federal Court.
  • Acted as junior counsel in a High Court trial representing multinational companies in claims involving passing off, copyright infringement, trademark infringement, and unlawful interference with trade.
  • Resolved a trademark assignment dispute through court-assisted mediation, achieving a favourable outcome for the client.

IP Enforcement and Dispute Resolution

  • Coordinated cease-and-desist and demand letters on behalf of clients, negotiating resolutions aligned with their interests.
  • Provided strategic advice to clients in responding to cease-and-desist letters, enabling the amicable and effective resolution of disputes.

IP Training and Advisory

  • Delivered in-house training for a major Malaysian banking institution, advising approximately 400 employees on software copyright ownership, infringement, and licensing.
  • Spoke on IP enforcement at a seminar organised by the Chinese Chamber of Commerce, Batu Pahat, in collaboration with the Malaysian Intellectual Property Association (MIPA).
  • Contributed to a MIPA webinar series as a speaker, guiding attendees through the process and best practices for ex-parte hearings before the Trade Marks Office.
